Salon (and Retail Shop) Insurance
We have a variety of packages available for all types of Health and Beauty Businesses. We also can insure many different kinds of retail businesses. Here is some basic information....
Salon
Most salons need a contents package and in some cases need extra malpractice to cover the corporate risk. There are specially designed packages around for this covering the sorts of risk described in the Business Combined Section of our website such as Buildings, Contents, Money and other Liabilities. See Commercial Insurance section for more information. The Proprietor may want to protect their income with Personal Accident or Sickness cover. There are, however issues to consider about the treatment risk
- If Therapists are employed, the malpractice can be arranged by the employer separately or included in the package.
- If Therapists are self employed and work at multiple locations, they need their own insurance as well as the Salon providing cover
-
If cheque is paid to a self employed therapist direct, and no advice or services are offered by clinic, then Contingent malpractice/treatment cover may not be really necessary, however this does not mean that someone will not try to sue them, if a problem arises- a corporate is deemed a better target by solicitors. See more detailed article about Clinics and Malpractice Insurance elsewhere on site.
-
If they give advice, provide reception services and/or receive money paid to them from which they pay the therapist, they need contingent malpractice insurance.
Shops
Similar to the Salon package above but usually with a Glass Frontage and in a more public area. Balens can cover most types of Retail Shop
-
Contents, Shop Front and Glass, Money, Employers, Public/Products liabilities and sometimes with treatment risk. Loss of Profits covers will usually include denial of access, loss of public utilities etc
-
Cover is usually on an All Risks basis.
-
Treatment cover is not usually relevant here
-
Can include Commercial Legal Expenses Cover.
Directors and Officers (D & O)
See above. Where a Charity or a Business have directors/trustees, they can be held legally liable personally for their actions by law. These policies will defend them against an allegation. These are dealt with under [SEPARATE SECTION] in more detail.
-
Typical allegations would be : failure to adequately look after the finances (breach of fiduciary duty): taking negligent decisions which adversely affect the organisation.
-
Allegations of fraud or misconduct. It is harder to attract Officers to organisations because of the responsibilities and legislation – D & O or Trustees Liability insurance gives a cushion of comfort.
Commercial Legal Expenses
A business can incur expenses and be vulnerable under the law of the land, and contract law. This is distinct from the law of Tort or negligence, which is covered by Professional Indemnity and other types of Liability Insurance. Rated on wages and turnover. They also cover help and advice lines on legal employment or tax issues
-
Criminal allegations
-
Inland Revenue Investigations,
-
Jury Service compensation
-
Disciplinery Hearings or loss of Statutory right to practice
-
Contract disputes,
-
Employment Tribunals and Disputes
Employment Practices Liability - EPL
A very recent addition, this replaces the need for Employment tribunal cover such as you would get in a Commercial Legal Expenses Policy.
Examples of typical claims situations, and good explanatory leaflets are available. Contact us .
-
EPL covers Employment Practices, so if there is a dispute or industrial tribunal they will pay for the legal help and awards.
-
Commercial Legal Policies also do this but require Client to follow strict ACAS guidelines and procedures, and this is not always possible for a client.
Public Liability
Know as "Trip and slip" cover. It is technically covering legal liability for injury or damage to other people or their property. Property Owners Liability protects a landlord or freeholder fromcalims arising from say a roof tile falling and injurying someone, other Public Liability claims protect a Company or individual for claims arising in the course of business. See the Products & Public Liability section.
Products Liability
Legal Liability for products sold supplied tested, repaired, demonstrated, manufactured etc. Most policies available don’t usually include covering a defect in the formula, design or advice etc. but only injury due to a defect in the product itself , innocently supplied. We have separate covers for product design etc - see the Products & Public Liability section for this.
Employers Liability
Indemnifies the Employer if employee is injured and Employer could be held legally liable
